The Design Professional's Lien

Course Description:

This course will describe the Design Professional's Lien and will detail the steps required to make sure the right to lien a property to secure payment is protected. This course also addresses other collection remedies that may be available to the design professional on public and private works including stop notices and payment bonds. Additionally, the class will discuss key provisions every design professional should have in their contracts to help make collections easier when a client is slow or refuses to pay their bill. Finally, the course will outline the things every business owner, design professionals or otherwise, should do to resolve a collections issue before calling their attorney or turning a delinquent account over to a collections agency.

Biography:

Michael S. Martin's practice emphasizes general civil litigation including construction defect cases, commercial and consumer collections, construction contracts, construction liens and enforcement of judgments. Mr. Martin has represented general contractors, subcontractors, and material and equipment suppliers in CSLB arbitrations, private mediation, and litigation. He also has experience with construction licensing issues and home improvement contracting.

Martin is also actively involved in code enforcement activities on behalf of the firm's municipal clients. These activities include criminal prosecutions of municipal code violators and seeking civil remedies.

He is fluent in Portuguese which he learned while he and his wife worked in Brazil with a non-profit organization for five and a half years. Upon returning to the United States from Brazil, Mr. Martin joined the firm as a clerk, began studying law, and earned his Juris Doctorate from Ventura College of Law in 2004.
