Tom Delaney’s Call for Action

On Monday, June 11th Tom Delaney, director of government affairs at the Professional Landcare Network (PLANET) asked members to support the H-2B amendment and stop the implementation of final H-2B ruling. Delaney said, ''Please call your senators today, and ask them to contact the committee chairman and ranking members, express their support for the Shelby amendment, and make sure the amendment is in the final funding bill before it’s voted on. Call and ask to speak to the staff person who handles the DOL appropriations. Tell him or her about how the H-2B rules will hurt your business and ask them to vote for the Shelby amendment.''

PLANET, which has been instrumental in the efforts to fight the H-2B regulations, is a plaintiff in two lawsuits against the Department of Labor (DOL). They have even sought out support from Congress, which Delaney now reports is taking up the cause.

The Senate Appropriations Committee will take up the fiscal 2013 funding bill for the Department of Labor (DOL) on Thursday, June 14th. During the debate, Senator Shelby (R-AL) plans to offer an amendment that would prohibit DOL from implementing the final H-2B wage methodology rule and the final H-2B program rule.


On Thursday June 14th, the Senate Appropriations Committee adopted the amendment offered by Senator Richard Shelby to block both the new wage rule and the new H-2B rules for the fiscal year 2013 (October 1, 2012 – September 30, 2013). For the proposed changes to be made they will now have to be approved by both the House and Senate and signed in to law by President Obama.

In response to the ruling PLANET’s Tom Delaney, Director of Government Affairs who is also part of the H-2B Workforce Coalition said, “We are going to need as much support as possible to retain this language in whatever the final funding bill, especially in light of several Senators’ comments about carving certain industries out of the amendment and having the rules apply to them.”
